《城市规划法》的适用范围《城市规划法》的适用范围指的是它所确定的法律范围的效力问题。概括地说，也就是它在那些领域范围内适用，它从什么时候开始发生效力和如何保证它有效实施。关于地域适用，《城市规划法》第三条和第四十四条明确规定了《城市规划法》的两种适用：（1）完全适用的。是指直辖市（北京、上海、天津、重庆），设市建制的市（包括省辖和地、洲辖的市），设建制的镇（包括县城和县或市所辖的一切建制镇）。这三个层次构成了《城市规划法》所称“城市”。（2）参照适用的。是指尚未设城市建制的工矿区的居民点。这类居民点的基本特征是其社会生活方式和规划建设发展与城市大致相似。此外，由于城市规划工作的特殊性，在《城市规划法》的地域适用效力中还有一个特定的概念，这就是“城市规划区”。简单地讲，城市规划区是由城市市区、近郊区以及城市建设和发展需要实行统一控制的区域，它的具体范围由城市人民政府在组织编制城市总体规划中根据实际需要划定。城市规划区是一个城市地域内规划、建设、发展的核心组成部分它的建设与发展成功与否，直接影响城市及其周围地域经济与社会的发展。因而城市规划区内的一切建设活动都必须严格按照城市规划进行安排并服从城市规划管理。这也是在“法”中设置城市规划区这个地域适用概念的基本原因。关于时间适用，《城市规划法》第四十六条规定：“本法字一九九○年四月一日起施行”。从这一天起，《城市规划法》开始发生法律效力，我国城市规划各项工作都必须以《城市规划法》作为根本法律依据而开展。由于国家法律是针对全国的普遍情况制定的，为了确保法能切实有效实施，《城市规划法》第四十五条固规定国务院城市规划行政主管部门附则制定实施条理，报经国务院批准后实施；各省、自治区、直辖市根据本法及其实施条例，制定实施办法。这里实际上是提出了要建立一个城市规划法规体系的任务。根据城市规划工作地方性较强的特点，地方法规和规章对于城市规划工作起着最直接的指导作用，这就要求各级城市规划行政主管部门，抓紧研究制定城市规划地方法规、规章和行政措施，确保《城市规划法》贯彻实施。
