标准备案标准备案registration of standardb旧oZhun bei’an标准备案(此颐s以ion ofs切叮ds记)标准批准、发布后，在规定的时限内，向有关标准化行政机关进行申请备案，接受审查和赋予备案号，以备查考。《中华人民共和国标准化法》中对行业标准、地方标准和企业标准都规定了备案的要求。这三级标准之所以要求备案，其目的在于:①当制造者和用户之间由于标准发生纠纷时，标准化行政主管部门可以依据备案的标准进行仲裁;②标准化行政主管部门可以通过标准的备案，了解各级标准的制定情况，便于发现行业标准、地方标准和企业标准是否遵守国家有关法律、法规及强制性标准的情况，保证各级标准的协调统一，维护国家标准的权威性与统一性;③有利于各级标准的统一规划、统一管理，协调各级标准的制定修订情况，避免标准的重复制定，便于标准化行政主管部门对各级标准的实施情况进行监督检查。行业标准备案行业标准主管部门在行业标准发布后的30日内，应将已发布的行业标准文本及其编制说明连同发布文件一式两份，送国务院标准化行政主管部门备案。备案的行业标准如违反国家有关法律、法规、强制性国家标准的，国务院标准化行政主管部门责成有关行政主管部门纠正或停止施行。地方标准备案地方标准发布后30日内，省、自治区、直辖市标准化行政主管部门和有关行政主管部门应分别向国务院标准化行政主管部门和有关行政主管部门备案，备案材料包括地方标准批文，地方标准文本及编制说明各一份。企业标准的备案企业产品标准应在发布后30日内办理备案。一般按企业的隶属关系报当地标准化行政主管部门和有关行政主管部门备案。从而确定企业产品标准备案的法律地位。企业标准备案的受理部门。根据《标准化法》规定，受理企业标准备案的是地方标准化行政主管部门和国务院有关行政主管部门或地方有关行政主管部门。企业的产品标准向地方标准化行政主管部门备案，可以协调企业标准与地方标准的关系，促进企业标准与地方标准的协调统一。对农药、食品添加剂、饲料添加剂、消防安全、医疗器械等产品标准的备案，省级标准化部门或行业行政主管部门有规定的，按照规定备案。中央直属企业依照《标准化法》的要求也必须同样申请企业标准化的备案，各中央直属企业可以向企业所在地的省级标准化行政主管部门申请备案，同时，也必须向其归口的行政主管部门进行备案。对于受双重领导的企业申请企业标准备案时，应同时向国务院有关行政主管部门和地方政府有关行政主管部门进行申请。(邓瑞德)
