热审热审中国明、清两代于夏季减等科刑的审判制度。目的是防止囚犯因暑热、瘟病流行而死于狱中。始于明成祖永乐二年(1404),开始只遣轻罪,命出狱听候,后来宽及徒刑、流刑罪以下。至成化年间,五月至六月,笞罪可以释放,徒刑可以减等;应枷号者可以免。后逐渐形成制度。清承明制,热审于顺治八年(1653)即已实行,于乾隆年间定制。每年小满后十日起至立秋前一日止实行热审。如立秋在六月内,则七月初一止。一般犯罪除死罪、军流及窃盗、斗殴伤人等罪不准减免外,杖罪人犯各减一等,笞罪宽免,应予枷号者暂行保释,立秋后再依法减等补施。但热审期内审定,逾热审期而发落者,均不适用减免。明代还偶有在冬寒季节减等科刑制度,以免囚犯因饥寒死于狱中,称寒审。
