法律规避法律规避law，evasionof当事人为了自己的利益，有计划地利用某国的国际私法规则，企图使其事实符合于该规则所定的连结根据（见抵触规则），借以适用依该规则应适用的法律，而规避原应适用于其法律关系而对他不利的强行法规。例如，甲国不认可离婚制度，不准离婚；但其邻近的乙国只须合于法律规定，便准离婚。按照乙国国际私法，离婚适用当事人本国法。两个甲国男女为了离婚，设法加入乙国国籍后，即在乙国法院诉得准予离婚的判决。这一情况就是法律规避。法律规避有时也发生在区际（如美国的州与州间）、人际（如不同的宗教信徒之间）的法律抵触之中。例如，按照美国国际私法，婚姻的实质成立要件（见结婚），适用婚姻举行地法。美国男女两人，住密歇根州，是表兄妹，拟结婚。按照密歇根州民法，表兄弟姊妹不得互相结婚；但邻近的肯塔基州民法，不禁止这种亲属间的互婚。该两人即到肯塔基州，按照该州的法律结婚后，然后再回到密歇根州。又如，在叙利亚，人的身分能力适用其所属宗教法。一个基督教徒受到应给付其妻赡养费的判决后，即改信伊斯兰教，因为按照伊斯兰教法，夫无须赡养其妻。上述情况，也是法律规避。有些国家针对法律规避行为，在国际私法立法中规定：规避国内法关于禁止结婚的法定原因而结婚者，其婚姻无效。但对禁止法律规避作出一般原则规定的立法，除葡萄牙、加蓬、西班牙外，还不多见。
