广告代理制广告代理制就是广告公司在广告经营中处于主体和核心地位，为广告主全面代理广告业务，向广告主提供以市场调查为基础、广告策划为主导、创意为中心、媒体发布为手段、同时辅以其它促销手段的全面性服务。实行广告代理制，可以使广告业内部形成良性运行秩序，最大限度地发挥广告主、广告公司与媒体的长处。对代理广告业务有以下规定：（1）代理广告业务，系指广告代理人在被代理人的授权范围内，以被代理人的名义从事广告经营活动，且其经营活动的法律后果由被代理人承担。（2）代理广告业务必须是经工商行政管理机关核准登记，在确定的文选经营范围中有代理广告业务项目的广告经营者。不是经工商行政管理机关核准登记的广告经营者，或虽然是广告经营者，但广告经营范围中没有代理广告业务项目的，不能代理广告业务。（3）广告媒介单位，即新闻单位经过工商行政管理机关核准登记，可以代理同类媒介的广告业务。一是广告媒介单位代理广告客户的广告业务时，只能代理在与其相同的媒介上发布广告；二是广告媒介单位只能代理与其相同的媒介单位承办广告业务。（4）广告业务代理费必须严格遵守《广告管理条例施行细则》的规定。即代理国内广告业务的代理费为广告费的10；代理外商来华广告业务，付给外商和国内代理者的代理费分别为广告费的15。（5）代理广告业务的代理人必须查验广告证明，审查广告内容。（6）广告经营者代理广告业务，应当与被代理人签订书面合同，明确各方的责任。
